1. Definitions

• Customer: Any person or entity who purchases, uses, or accesses our services or products.

• Products: Refers to cabinetry and related goods available through TODO Cabinetry Store.

• Site: Refers to our website located at www.todocabinetrystore.com.

• Business Days: Monday through Friday, excluding holidays.

2. Eligibility and Use 

You must be at least 18 years old or the age of majority in your jurisdiction to use our website or purchase products. By using our site, you represent that you have the legal authority to enter into a binding contract.

3. Product Availability and Pricing

• All products are subject to availability.

• Prices and product descriptions are subject to change without prior notice.

• We reserve the right to cancel any order if a product is incorrectly priced or becomes unavailable.

• In the event of a pricing error, we will contact you to confirm whether you wish to proceed at the correct price.

4. Order Acceptance & Processing 

Your order is not finalized until:

• We send you a written Order Confirmation via email.

• Full payment has been received.

We reserve the right to refuse or cancel orders at our sole discretion, including for:

• Suspected fraud

• Errors in product information

• Unavailable inventory

5. Payment Terms

• Full payment is required at the time of checkout.

• We accept major credit cards, debit cards, and other payment methods as offered on our site.

• Payments are processed securely through third-party providers. We do not store your credit card information.

6. Shipping, Delivery & Inspection

• We offer curbside delivery through third-party freight carriers. Inside delivery is not included unless specifically arranged.

• You must inspect all shipments immediately upon delivery. Any visible damage must be noted on the delivery receipt before signing.

• Claims for concealed damage must be submitted within 48 hours of receipt.

• You are responsible for ensuring accessibility for freight delivery (e.g., clearance for trucks, unloading area).

7. Return Policy

• Returns must be requested within 30 days of delivery.

• Only unassembled, unused, and unopened items in original packaging are eligible.

• Custom or special-order items are non-returnable.

• A 15–25% restocking fee and return shipping costs apply.

• Returns without prior authorization will be rejected.

8. Cancellations & Modifications

• Orders may be canceled within 24 hours of placement without penalty.

• After 24 hours, cancellation requests may incur a restocking or administrative fee.

• Orders that have shipped or entered production cannot be canceled.

9. Limited Warranty 

TODO Cabinetry provides a 5-Year Limited Warranty against manufacturer defects in materials and workmanship. This warranty does not cover:

• Improper installation or modifications

• Wear and tear from normal use

• Damage due to water, humidity, sunlight, or chemical exposure

• Cabinets installed in commercial settings (unless otherwise approved)

10. Product Disclaimers

• Wood is a natural material and may vary in grain, color, and texture.

• Finish samples are a close representation but not an exact match.

• Painted products may show hairline cracks at joints due to expansion and contraction.

• These characteristics are not considered defects.

11. Intellectual Property

All content, including logos, trademarks, text, images, and design elements, is the intellectual property of TODO Cabinetry Store or its licensors. Unauthorized use, reproduction, or redistribution is prohibited.

12. Limitation of Liability

To the fullest extent permitted by law, TODO Cabinetry shall not be liable for:

• Indirect, incidental, or consequential damages

• Loss of profits, data, or use

• Delays in delivery due to carriers or third parties

• Damages arising from improper installation or misuse 

Our total liability shall not exceed the purchase price of the affected product.

13. Indemnification

You agree to indemnify, defend, and hold harmless TODO Cabinetry Store, its affiliates, officers, employees, and agents from any claims, liabilities, damages, and expenses arising from:

• Your breach of these Terms

• Your misuse of our products or services

• Your violation of any law or rights of a third party

14. Governing Law & Jurisdiction 

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any legal action or proceeding shall be brought in the courts of Stratford, Ontario, and you consent to personal jurisdiction therein.

15. Force Majeure 

TODO Cabinetry shall not be responsible for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, labor shortages, supply chain disruptions, war, or governmental action.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain valid and enforceable.

17. Changes to These Terms 

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of our site constitutes acceptance of any modifications.
